High Court orders legal action against 'fake doctors'

The High Court has directed the government to take appropriate legal action against the ‘fake’ doctor who does not have a valid certificate and registration for practice as a doctor.

The High Court bench of Justice KM Kamrul Quader and Justice Mohammad Ali gave this order on Tuesday.

Bangladesh Medical and Dental Council (BMDC). The President and Inspector General of Police (IGP) have also been directed to submit a report within 3 months in accordance with the direction of the High Court in 3 months. At the same time, they have been issued a rule to explain why they are in vain to amend the existing 3 years imprisonment for the punishment of ”Bhuta” doctors and the health of the patients.

In the rule, it is asked why steps should not be taken to amend the Medical and Dental Council Act-2018 (3) and 29 (2) to increase the punishment of the officials.

The Supreme Court lawyer asked for necessary instructions in this regard. The High Court bench of Justice KM Kamrul Quader and Justice Mohammad Ali gave the order in view of a writ petition filed by JR Khan Robin.

He submitted the application as a public interest case to the High Court on November 29. In order to increase the amount of punishment for ‘fake’ doctors, the government has asked for instructions to amend the relevant laws. In the application, he said, ‘Many patients are being cheated by fake doctors who have not had a valid certificate of practice and unregistered practice.’

Mentioning that such ‘fake’ doctors are creating a serious threat to the health of patients, he said, ‘The punishment for such illegal acts is only 3 years imprisonment and a fine of 1 lakh taka which is very inadequate.’

Petitioner JR Khan Robin presented the application himself and Deputy Attorney General Abdullah Al Mahmoud Bashar was present for the state during the hearing of the application today.
