Policy to ban coaching business is valid: High Court

The High Court has ruled that the policy banning coaching business is valid. The Ministry of Education issued the 'Policy Banning Coaching Business for Teachers in Educational Institutions' in June 2012. A double bench of Justices Sheikh Hassan Arif and Razik Al Jalil gave the verdict after hearing on coaching centers on Thursday (February 7).

The court, after concluding the hearing on the policy to ban the coaching business and the rule issued on the issue of taking action against teachers involved in the coaching business, posted the verdict on these writs for February 7. Khurshid Alam Khan represented the ACC in the court. Barrister M Amir-ul Islam represented the writ petitioner. Fida M Kamal was the amicus curiae.

The authorities concerned have issued notices to show cause why action should not be taken against some teachers of Motijheel Government Boys' School in the capital based on the ACC's investigation report into allegations of coaching business. The teachers have filed a writ petition in the High Court against those notices and the Policy on Prohibition of Coaching Business by Teachers of Educational Institutions-2012.

The government issued this notice based on the Anti-Corruption Commission report. The teachers filed a writ petition in the High Court against these notices and the policy of banning the coaching business of teachers of educational institutions-2012.

The court issued a rule on February 28 last year, suspending the effectiveness of the letter for four months.

The ACC and the state filed leave to appeal against the order in the Appellate Division. After hearing the application on February 27 last year, the Appellate Division directed the High Court bench headed by Justice Sheikh Hasan Arif to dispose of the rule by July 31 last year.

Later, the court appointed two former Attorneys General, Hasan Arif and Fida M. Kamal, as amicus curiae to resolve the rule.
