If the parents are separated, who will have the children?

Although divorce is frowned upon in Islam, it is recognized as religiously valid. When it is no longer possible for the husband and wife to live together, the option of separation through divorce is reserved.

According to the Muslim family law in Bangladesh, either the husband or the wife can divorce. However, the wife's power to divorce is conditioned. The biggest victim of this divorce is the child of the couple. Complications arise especially with regard to child custody or maintenance, alimony etc. Many people have to go to court with these complications.

Guardianship of:

According to the Guardian and Guardianship Act 1890, the father is the actual legal guardian of the child. However, if the parents are separated, the mother has the legal right to keep the child for a certain period of time for the sake of raising the child. However, even at that time, the maintenance must be given to the father.

Who is the natural custodian of the child:

In case of separation between the husband and wife, the child will normally remain in the custody or maintenance of the mother for a period of seven years in the case of a male child and until puberty in the case of a female child. In this case the father is the legal guardian but the mother is the custodian or custodian of the child. However, the father will have the right to see the child during this time. After this time the children can be taken by their father if they want. If the mother wants to keep the child in her custody even after this period, then the permission of the court must be taken.

Go to a court:

According to the provisions of Section 5 of the Family Court Act 2023, the Family Court has jurisdiction to receive, try and settle any litigation related to the guardianship and supervision of children. In such cases, the court takes into account what is best for the welfare of the child. Ekshatra also considers financial solvency, whether there is anyone in the father's family to raise the child, whether he is addicted to drugs or not. In this case, if it is agreed, the custody is shared between the two people. Maybe two days a week with the father and the remaining five days with the mother, this is also given. However, the court gives the opportunity to spend time visiting the child of the other party, regardless of who has custody. Even if you are deprived of that opportunity, you can take recourse to the law.

The child's opinion is accepted:

The opinion of the child is always important in awarding custody or responsibility. In this case, the court also accepts the opinion of the child. However, many times, the custodial person may influence or intimidate the child to take opinions. So even after taking the opinion of the child, the court observes it. Therefore, although the opinion is a matter of consideration, liability is not given solely on the basis of the opinion of the child. In this case, the court tries to decide whose custody will actually be in the best interest of the child. For example, the advantages and disadvantages of maintenance or upbringing are also considered in this case.

Corruption, Aladdin's lamp and Pandora's box

Power is the modern version of Aladdin's lamp of the Arabic rosin, the lamp that can be lit without the help of a demon to become the owner of great wealth. And the strategy to own this wealth is called corruption.

That is, power, corruption and wealth are now complementary to each other.

When Aladdin in the story rubbed his leg, the giant would come and say to him, 'Order, master. '

But in reality Aladdin's monster looks different. This monster appears sometimes in the form of administrative power, sometimes the fear of arms, sometimes the fear of prosecution or crossfire, and sometimes the temptation to obtain some great advantage.

The last one who is making a fuss all over the country about 'Aladdin's lamp' is Benazir Ahmed, former police chief and former director general of RAB. who has also received the Rashtriya Shuddhachar Award.

It would not be wrong to call him the 'most influential police officer' in the history of Bangladesh from the appearance of this police officer who was discussed in various incidents including the removal of Hefazet Islam leaders and activists from Shapla Chattar in Motijheel in 2013. The question is, Kal Kantha, in a long investigative report titled 'Aladdin's lamp in Benazir's house' on March 31, which opened the Pandora's box of such a powerful and powerful person, what is the message?

Two questions are swirling in people's minds.

1. Bangladesh has an 'independent' anti-corruption commission and they have caught many big and medium corrupt people under the law. Many have been investigated. Many are under investigation. An influential person like Benazir Ahmed, who served as the head of the state's largest law and order force during many major incidents, did the ACC not inquire about his assets?

2. His wealth, which has been detailed in the report, is in the sum of Rs. For example, Savannah Eco Resort in Gopalganj is a luxury resort; Investments of more than 500 crore rupees in at least six companies in different areas of the country in the name of wife and two daughters; Expensive flats, houses in elite areas of the capital and bigha after bigha of land in expensive areas near Dhaka; Two lakh shares in Best Holdings and five-star hotel La Meridien in the name of two daughters; In Purbachal, a duplex house on a vast area of 40 kathas and another 10 bighas of land worth 22 crore rupees etc. The question is, in what process did Benazir Ahmed acquire this wealth?

The question is because it is impossible to buy a small house in Dhaka city with the salary, bonus and other financial benefits he got throughout his life as a government employee and the money he got after retirement. However, the details of his assets that are available in the news published in the media, are hundreds or thousands of times more than his lifetime income.

Where did he get this money or in what process did he get it?

There are three ways to get rich in fat spots.

1. Vast wealth inherited from parents.

2. big business

3. Corruption.

In the reality of Bangladesh, no matter how big and how high paying the government job is, it is difficult for anyone to own a flat in Dhaka city for two to three crore rupees, unless there is a hefty bank loan. A government employee has no chance to save much money after living on salary alone. However, many third and fourth class employees have become owners of multiple luxury flats in Dhaka city, cars, resorts near Dhaka, picturesque buildings in village houses, bigha after bigha of crop land - many such news have made media headlines. Many have been arrested. is in prison Many others have also disappeared from the news pages. Apart from this, many more people are still becoming the owners of huge wealth and prosperity by abusing and corrupting the power of Aladdin.

So this incident of Benazir Ahmed cannot be considered as a very new or an isolated incident. This is just a small case study of a corrupt economy. However, its fundamental difference with the other 10 incidents is that Benazir Ahmed is an influential person and in today's journalism where corruption and crimes of people associated with power are tried to be avoided as much as possible, the Pandora's box that the voice of the time opened or could give is undoubtedly admirable. .

For those who are upset that there is no journalism in the country or investigative journalism, this kind of report gives hope. In this age of social media, when there are door-to-door journalists, when YouTube content creators claim to be journalists, and when mainstream media seems to be losing ground to social media, this type of journalism is not just about one or two newspapers or television channels, but about the entire media. Somewhat hurt existing negative perceptions. The stakes in this type of journalism are high. But it needs more.

The weak point of the report is that there is no statement of the accused. However, according to this report, several calls were made to Benazir Ahmed's mobile phone to inquire about the complaint, but he did not receive it. Khude did not even respond to messages. Two things usually happen in these cases. 1. The accused person does not answer the call of the journalist or 2. In some news reports, when questioned about the allegations, he denies them or the accused claims that the allegations leveled against him are false and false. Therefore, even if this type of disparaging speech is ultimately not very effective, the ethics and structure of journalism require the statement of the accused.

Reports of such corruption bring two issues to the fore.

1. Where is the implementation of the government's zero tolerance policy against corruption? Can the government name even a single state service institution, including the police force, that has been completely free of corruption or where corruption has been reduced? Even after making the activities of many government service organizations internet-based and digital, has corruption decreased in all those organizations?

2. When a crime is alleged or proven against a member of any force, the force immediately says that neither the force nor the government will be held responsible for the person's crime. The question is, if there is a structural problem in any force or institution; If the system there is such that one can get away with huge wealth by intimidating or speeding up the administrative power or giving illegal favors to someone and get away with it easily, then why is the responsibility of the crime of any person associated with that force or organization Institutions and governments will not take?

Kishore gang: children are mixing with whom?

Teenage gangs have become reckless. Every day somewhere gang members are causing various incidents.

There is no crime that they do not commit, including murder, robbery, extortion, kidnapping.

Juvenile criminals cannot be controlled despite multifaceted efforts of the law and order forces. Common people are afraid of them. Because at the root of these misdeeds of juvenile gang members are their so-called 'elder brothers'. Not only in the cities of the country, the members of Kishore gangs are now also active in different upazilas.

It is being said in the media that 'teenage gangs' are active all over the country. There are more than 70 juvenile gangs in Dhaka city. RAB-Police have arrested more than 200 people, including the head of local youth gangs, from July 2023 to this year. Most of the 2,232 pending cases are related to juvenile gangs. In 2023, 25 people were killed by juvenile gangs in Dhaka alone. In the two years 2022-23, 34 people died in their hands (Source: Dhaka Metropolitan Intelligence Department).

According to information from 16 police stations of Chittagong Metropolitan Police, more than two hundred youth gangs are active in Chittagong city. Each team consists of 5 to 15 people. Their membership in the city is about two thousand. 64 'elder brothers' patronize juvenile gangs. They control 45 important areas of the city. Youth gang leaders involved in groupings, clashes and murders centered on various issues including extortion, control of tenders in government offices, garment business, land grabbing, beating or cornering opponents. And the elder brothers who are said to make the group heavy are making the youth go astray. Most of them belong to lower and middle class families. Despite being a juvenile gang in name, the group also includes 20 to 32 year olds. The people of the city are holding protest rallies and human chains against the emergence of juvenile gangs, drugs and eve teasing.

Juvenile crime cases have also increased in Chittagong court. Currently 2 thousand 232 cases are under trial. Most of these cases involve juvenile gangs, prosecutors said. Rapid urbanization has destroyed the leisure environment and neighborhood of teenagers. Due to changes in family and social structures and the absence and narrowing of sports and other recreational facilities, the deficit in leisure recreation is being filled by artificial environments and modern information technology.

Parents are also very busy and do not have time to spend time with their children and some of them do not even feel the need. Now various groups are being formed through technology. Adolescents may not have the ability to understand the pros and cons of groups. A kind of frenzy operates among the rising teenagers. They are being influenced by someone else. They gather together in one place through information technology without any physical infrastructure to plan criminal activities, commit heinous crimes like murder and murder.

On the contrary, there are groups in the society, who are as young as they are, studying in some college or university, or even not studying at all; But by spending their own money, they are forming groups for various social work. They are spreading the light of education, cleaning the roads and working to protect the environment, standing next to the helpless people or saving people's lives by donating blood voluntarily. Such teenagers are also people of our society. They are admired for their differences in upbringing and upbringing, differences in family and society, and for not being associated with anything bad or taking chances.

When we look at both the good and the bad in society, it is up to us to make the bad group better. All work should be done where there is no chance of getting worse. A major factor among teenagers is their young age and lack of maturity, due to which they do not understand what is right and what is wrong. As a result, gang culture often seems like a big deal. Physical changes and accompanying changes in mental state as well as family and surrounding environment help them to associate and form groups.

Bangabandhu's daughter Prime Minister Sheikh Hasina, while delivering a speech on the occasion of the inauguration of the District Commissioner's Conference, highlighted the problem of juvenile gangs in the society and urged every family to increase vigilance over their children. He said that no one's children should get involved in juvenile gangs, militancy, terrorism and drug addiction. It is not useful to just arrest, you have to be aware. So it should be caught from the beginning. It has spread during the course of Covid-19 and has come to the fore at this time. The task of bridging this gang culture must start from the family. After the Prime Minister's call, there has been widespread awareness across the country at all levels to prevent this problem.

We need to give opportunities and encourage children and adolescents to participate in various social service activities in addition to their studies without keeping them confined at home. Parents should take such initiatives. It will inculcate the seeds of humanitarianism, compassion and empathy in the youth. Various activities including Scout Cub, Girls Guide, BNCC, Rover Scout can be made compulsory in schools, colleges and universities. It may also be made compulsory for students to engage in community service activities while awarding the degree. And if any unruly behavior is observed, action should be taken, there is no leniency in punishment.

It is not possible for the police alone to prevent it. Families must be careful with whom our children associate.

Without TikTok in the US, small businesses will be in danger

IT Desk

Last Wednesday (April 24), the US Senate passed a bill to ban the popular social media app TikTok. Hours later, President Joe Biden signed the bill into law. This law requires ByteDance, the parent company of TikTok, to sell the app to a company or individual outside of China, i.e. in another country. Or TikTok should be shut down in the US. TikTok, however, has announced a legal battle challenging the law.

By next year, many die-hard fans of social media platforms in the United States may lose one of their favorite pastimes. But without TikTok, the most affected will be the content creators of TikTok and the small businesses that earn money using this medium.

As of March 2024, more than 7 million US small businesses use TikTok. TikTok says it will generate $15 billion in revenue for these business ventures in 2023.

TikTok has become one of the global economic powerhouses today. According to TikTok's report, small and medium-sized enterprises built using the platform contribute 4.8 billion euros or 5.14 USD to the GDP of Germany, France, Italy, the Netherlands and Belgium.

US entrepreneurs fear a drop in their income due to fears of TikTok shutdown. Similarly, global businesses also target US consumers in product marketing. The US audience is also a top target for content creators. Small and medium businesses and content creators who rely on social media platforms worldwide are therefore worried. Finding an alternative to TikTok is a big challenge for them now.

Finding a growing audience and consumer

27-year-old Shira is a full-time content creator on TikTok. He has more than five lakh followers on TikTok. He opened a TikTok account in 2021 after moving to the United States from Australia. Initially he used to create reaction videos on other content. He also made content about his experience living in the United States. Within nine months, his number of followers grew exponentially.

Shira relies on TikTok partnerships for revenue. He also has accounts on Snapchat and YouTube, but according to him, the platform that consistently earns the most is TikTok. He told the BBC, "It took me a few years to build a truly dedicated audience on TikTok. I have done a lot of live streams, I have given a lot of content. The journey to making money from TikTok has been tough. But now I'm really grateful for where I'm at.

Shira described the ban as devastating. Outside of his own business, he said, hundreds of thousands of jobs could be lost because of the ban. Earlier last March, TikTok said that the app has created at least 224,000 jobs in the United States. "I am not sure what these people will do if TikTok is banned," Shira said.

30-year-old Ileana Justin has nearly two lakh followers on her TikTok account. He also expressed similar concerns as Shira. In 2021, she and her husband posted on TikTok about requiring guests to wear masks at their upcoming wedding to prevent the spread of the coronavirus. Through this he started publishing content on his TikTok account. Since then he entered the world of controversial content creators. He mainly creates content on lifestyle, political topics. His content topics include topics such as paid family leave, abortion, and gun control.

But Ileana is not a full-time content creator like Shira. But he spends a lot of time on the platform. He is concerned for others beyond his own financial calculations. He is especially worried about those who are completely dependent on their success on TikTok to earn money. Ileana said the platform gives small traders an opportunity to market products and grow businesses. Businesses can be completely transformed using TikTok. I have many friends who have turned their businesses into full-time jobs because of TikTok.

Search for alternatives

But according to experts, banning TikTok may not do much harm to small businesses. But they must find an alternative and adapt to it.

Professor Mohammad Rahman of the Department of Management at Purdue University Daniels School of Business in the United States said, We are living in a digital economy. We are largely dependent on technology for all forms of communication and information. The idea of going back to how business was done before social media probably won't work anymore. Because consumers around the world are influenced by social media in how we gather information, how we buy what.

If TikTok is banned in the US, there are alternatives like Facebook. Experts predict that other social media may follow. Businesses are at hand to figure out their next steps. ByteDance has 270 days after President Biden signed the bill banning or selling TikTok on Thursday. However, if ByteDance has a legal battle, this time may increase.

Kristen Schiely, an associate professor of clinical marketing at the University of Southern California's Marshall Business School, says it's hard to say right now whether users will migrate to any platform if TikTok shuts down. In fact, Gen Z spends the most money on TikTok. Other platforms aim to reach Gen Z.

American TikTok users are not only a domestic business force, but have global influence. Entrepreneurs from other countries will lose TikTok's US audience. Some in the UK and Canada have already expressed concern. Last March, a TikTok spokesperson in Canada told Global News via email that a ban on TikTok in the US would be devastating for Canadian content creators and small businesses. The main goal of many Canadian small businesses and content creators is to reach Americans.

Shielli said many cosmetic and skin care brands from Korea and China are coming to the United States. The quality of beauty and skin care products from Korea and China is excellent. Right now their business is very big on TikTok. They too will find it difficult to reach US consumers without TikTok. International brands will also find it difficult to reach US consumers. Shealy hopes many will adapt, but worries that many small businesses will be lost to big companies and international brands.

Tax exemptions should be announced now to boost investment in the ICT sector

The ICT sector of the country started its journey in the late eighties of the last century. Later in the nineties we started working with software. The beginning of Basis was also then, 27 years ago. We have progressed a lot during this time. There were so many things that could have happened again, that didn't happen. We are now exporting about one and a half billion dollars. The local market is also about one and a half billion dollars, although a lot of foreign software is coming. The export or domestic market was supposed to be bigger. It didn't for a few reasons. The main reason for this is the shortage of skilled human resources. We may not have tech savvy people at the helm. People who really know technology may not be coming to leadership. As a result, we cannot move at the speed we want to.

Another reason is that we don't have skilled manpower. We did not take steps to make it. This is not only the case with ICT. Same situation in almost every case. We have not taken adequate steps to develop skilled manpower even at the national level. It should have been done 20 years ago. If we did it 20 years ago, we can reap the benefits now. India has done that. They did IIT in the sixties. They took its benefits in 2000. We could not do these things. If we can't take that step to build a smart Bangladesh without wasting any time, then we won't be able to do anything.

There are photo shoots and digital marketing, there are various promotional videos. Since technology is now so affordable, it has become easier to do this. When we elected 10/15 years ago, we did a photo shoot. But I could not do so much digital marketing. Technology was not so hand-in-hand. Now they are because the technology is affordable.

But the important thing here is the panel. Personally I am against panel system. I don't like it. The main reason is that whenever a panel is formed, there are two or three panels—the differences or rivalries that occur remain after the elections. No matter how much we say in our mouths, everyone is the same after the election, in reality it is not. The issue of factionalism remains in the mind. This is why I am against the panel system.

If that were the case, there would be separate elections for the posts of president, vice-president and director, then there might not have been a panel. Again, there is an argument for the panel. If I can't form a board with similar people, the board won't run. Because my way of thinking is one, another person's way of thinking is different. Yet I think this is exacerbated by the partisan, panel system.

The one or those who will be in the leadership, but they must be people of this sector. There should be a direct connection in this industry. Otherwise, he will not be able to understand and feel the problems. Those who have problems cannot feel the pain they are suffering. So the leadership is needed, the leadership that knows this sector from inside. Just as we need people who know technology, we also need people who can understand good management and lead. It is hoped that those who will come forward in BASIS, those who will come in the future will think like this. Voters also think about the qualities of leadership they will vote for.

Silent killer smartphone!

Conduct ICT subject exams

Instead of the optional Computer Education of 200 marks in the curriculum, the compulsory 'Information and Communication Technology' of 100 marks has been introduced for students of six branches.

Several education experts at the time commented that this government initiative was very timely. This would make students more self-reliant in the workplace. Digital Bangladesh The main tool for building is information and communication technology. And to use this technology, skilled ICT-knowledgeable human resources are needed. To create skilled human resources, appropriate computer education, including practical, is needed. But it is not possible to apply ICT in computer education without practical. Although there is no guideline on practical and mark distribution in information and communication technology, which is mandatory from the beginning, there will definitely be practical in this regard in the periodic meetings with the authors at NCTB and marks have been allocated for this, which when informed verbally, the authors have prepared the manuscripts of their books and published them with approval from NCTB. About two dozen books have been approved, circulars, office notices, etc. and many more.

Since 2016, ICT has been included in the creative exam in the Higher Secondary Examination. Last year's university admission test had questions from ICT, not only that, but also questions from ICT in any job interview, BCS exam, and this trend continues. This ongoing issue was being discussed with due seriousness, but suddenly various media outlets are spreading the news that ICT exams will not be held or have been canceled. Students have also given up. Ordinary students do not even want to take classes on subjects that are not tested; as a result, they will fall behind in vast knowledge like ICT.

Sheikh Russell Digital Labs have been established in most schools and colleges. Which will play a major role in ICT education and application of ICT in the educational sector. But if there is no ICT exam, the higher secondary examinees will lose interest. Laptops and equipment in the labs established at the expense of government money will be damaged due to negligence.

On the occasion of Mujib Centenary celebrations in 2020, NCTB published a book on ICT for higher secondary classes. This is a gift of Mujib Year. This year, students are going to participate in the Higher Secondary Examination by reading that book. But suddenly it is being advertised that there will be no examination on ICT. So, will there not be an ICT examination for the first time in the light of the ICT board book published on Mujib Centenary? Those concerned should think deeply about the matter.

Passing in ICT is very easy and helpful in improving GPA. It is being propagated that ICT is difficult for students. It is very easy to get A+ marks as the practical marks are 25. But due to false propaganda, this important subject is under threat today.

Senior officials of the Secondary and Higher Secondary Education Board have said that 'there will be no examination in ICT subjects in SSC and HSC' is still in the proposed form. If that is the case, then I am drawing the attention of the concerned to take such a decision by canceling the proposal, not canceling the examination, and shortening the short syllabus of ICT, but in the light of the ICT book of the Mujib Centenary Gift NCTB, the first examination will be held like all the subjects.
